De Nederlandsche Bank N.V. (DNB) issued a designation to Ebury Partners Belgium N.V. in July 2021 for not linking itself to the Bank Details Referral Portal.
Banks and other payment service providers (PSPs) in the Netherlands are required to connect to the Referral Portal. The Referral Portal allows for an automated digital exchange of certain bank details between the banks/PSPs and the Dutch authorities. DNB monitors banks’ compliance with this connection obligation. Note that a bank/PSP that is not linked to the Referral Portal hinders the automated exchange of information with the authorities. This makes it difficult to combat ML/TF.
After several warnings and reminders to comply with the connection obligation, Ebury still did not connect itself to the Referral Portal by July 15, 2021. DNB therefore issued Ebury an instruction, asking Ebury to connect itself to the Referral Portal by September 1, 2021. Ebury complied with the instruction by the given deadline. Note that while Ebury objected to the instruction, DNB declared the objection unfounded in December 2021.
